On the 17th December 2025 the European Parliament passed a resolution calling for the European Commission to set up a EU-funded financial mechanism to pay for travel and abortion procedures for those in the EU countries to travel to other EU countries with more liberal abortion laws than their own.

This comes from a European Citizen Initiative called “My Voice, My Choice” supported by IPPF. They collected signatures in Europe during 2024-2025.

This Resolution of the European Parliament is a significant over-reach of the EU, as it is not within the rights of the EU to engage in the matter of abortion. Abortion is a national competence, which falls not only within the remit of public Health, but also in some countries within that of criminal law. This Resolution undermines the principle of subsidiarity in the EU.

If this were to become law, the most liberal abortion laws in the EU would, in effect, become the EU law regarding abortion whichever country you are in, and would result in EU funded abortion tourism. In some Member States abortion can be permitted up to 24 weeks and even up to birth in certain circumstances. According to this proposal this would be accessible to all EU citizens.

Abortion is a national issue, not an EU decision, let's keep it that way!

Dear Commissioner Dombrovskis,

I am writing as a concerned citizen of Latvia regarding the European Parliament resolution adopted in December 2025 in support of proposals linked to the “My Voice, My Choice” European Citizens’ Initiative, including the possible creation of EU-funded financial mechanisms to facilitate access to abortion services across borders.

Under the current EU Treaties, abortion policy clearly falls outside the legislative competence of the European Union. Pursuant to Articles 4(2)(k) and 168 of the Treaty on the Functioning of the European Union, public health remains primarily a national responsibility, with explicit limits on EU intervention in the organisation and delivery of healthcare services. The Treaties expressly exclude the harmonisation of national laws in this area.

From a constitutional and democratic perspective, abortion regulation is closely connected to national constitutional identity, ethical traditions, and democratic self-determination. For this reason, Member States retain full authority to determine the legal status of abortion, the conditions under which it may be permitted, and the extent of public funding. This allocation of powers reflects the principle of subsidiarity under Article 5 of the Treaty on European Union, which is particularly important in morally sensitive areas where no European consensus exists.

While the “My Voice, My Choice” initiative has met the formal requirements for consideration as a European Citizens’ Initiative, it is important to recall that an ECI does not create new EU competences, does not bind the Commission to propose legislation, and merely requires the Commission to examine the initiative and provide a reasoned response. The existence of other citizens’ initiatives, such as “One of Us,” which as it happens gathered a greater number of verified signatures, demonstrates that there is certainly no consensus among EU citizens on this issue.

The European Parliament resolution adopted in December 2025 is a political statement and has no binding legal force. Nevertheless, framing abortion access as an EU-level right, or proposing EU-funded mechanisms that facilitate cross-border abortions, risks blurring the boundaries of EU competence and indirectly undermining national laws adopted through democratic processes. Such an approach also risks compromising the EU’s institutional neutrality on matters of profound moral disagreement.

I therefore respectfully urge the European Commission to uphold the Treaties, respect the principle of subsidiarity, and refrain from advancing any proposal that would extend EU involvement into areas of healthcare, abortion, and medical ethics that remain the responsibility of Member States.
